If you are or were a pilot for Alaska Airlines Inc. or Horizon Air Industries Inc. who took short-term military leave from October 10, 2004 through the present, a class action may affect your legal rights.

The lawsuit is a class action brought under USERRA. The Class Representative who brought the lawsuit is a current Alaska and former Horizon pilot. The Defendants, i.e., the parties that are sued in this class action, are Alaska Airlines Inc. (“Alaska”) and Horizon Air Industries Inc. (“Horizon”).

The lawsuit alleges that Alaska and Horizon have violated USERRA by failing to provide pilots with paid short-term military leave while providing paid leave for other comparable forms of leave such as jury duty and bereavement leave.

Defendants have denied the claims in this lawsuit and maintain that, even if Defendants are found liable, Plaintiff and other members of the Class are not entitled to relief.

The Court has not decided whether Defendants violated USERRA. By allowing this case to proceed as a class action and this Notice to be issued, the Court is not suggesting that Plaintiff will win or lose.
